10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EK BALAM CREATECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS
WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS,
REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE
TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
11) Indemnification
You agree to defend, indemnify, and hold harmless EK Balam Createch LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.
12) Termination
We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or applicable law. You may stop using the Services at any time.
13) Governing Law; Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction and venue of state or federal courts located in Travis County, Texas.
14) Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
